Today, it is important to understand that there is no guarantee that a bail motion will be granted when compared to better chances just a few years ago; indeed, a recent study of current precedent leaves me to conclude that successfully moving a court can be very difficult. My research indicates that the approximate market rate to have an attorney draft and make one appearance in court on a bail bond motion ranges from $1,500.00 to $2,400.00 per bond forfeiture depending on the attorney. Because of the cost for uncertainty, many bail agents opt to wait for forfeited bonds to self-resolve, which, I think, we can all agree is risky at best.  Many, many bail agents have little to no understanding of the bail motion process, and many wait until the last possible second before seeking attorney assistance or to personally delve into the intricacies of doing their own bail bond motions. Some bail agents have learned why having a working knowledge of the bail motion process is absolutely critical but only after having to pay a summary judgment. A summary judgment can literally shut a bail bond company down, and the owner could very literally lose his or her property or cash collateral that was put up with a surety, so perhaps it is worth considering the benefits of being proactive rather than reactive when it comes to transacting bail.
